Terms of Service — Subtightl

These Terms of Service ("Terms") govern your use of the Subtightl mobile application and related online services (the "Service") operated by BLAID Staq ("we", "us", "our"). By using the Service, you agree to these Terms.

1. The Service

Subtightl helps you generate and export subtitles/captions for videos you provide, using automated speech recognition through our secure backend. Availability and quality depend on third-party APIs, your device, and network conditions.

2. Eligibility and accounts

You must comply with Apple App Store and Google Play rules. Some features require sign-in. You are responsible for activity under your account.

3. Credits and one-off packs

Credits represent prepaid transcription time (typically shown in minutes or seconds). Usage is enforced server-side. See in-app purchase descriptions and your balance for current rules.

4. Subscription — "Unlimited" and fair use

We may describe the paid subscription as "Unlimited" for short. That means no per‑minute credits for subscriber transcription while subscribed — not unrestricted instantaneous capacity, guaranteed turnaround, or suitability for every automated/high‑volume workflow.

Fair use. To keep the Service responsive for all subscribers, we apply technical fair‑use measures to sustained high‑volume use. These can include throttling, queue delays, reduced concurrency, and as a financial backstop, temporary suspension of new jobs until the next UTC midnight. The exact thresholds, ratios, and active mix of measures may change at any time without prior notice. Current parameters are documented in our public configuration and may be tightened or relaxed in response to capacity, abuse, or upstream cost changes. The headline guarantee is that paying subscribers will continue to receive transcription service for personal/individual use within reasonable limits — not that every requested job will run instantly or at all under heavy load.

No SLA: The Service is provided on a best-effort basis. We do not guarantee speed, concurrency, uptime, queue times, turnaround for any particular job, or caption accuracy.

5. Fair use and abuse prevention

You must not degrade the Service for others. We may use technical measures — including bursts, concurrency limits, throttling, queue delays, suspensions — to protect stability and fairness.

6. Content you submit

You are solely responsible for the videos and audio you process. Only submit content that is lawful where you operate and content you may lawfully transcribe.

7. Payments

In-app purchases and subscriptions are processed by Apple or Google pursuant to their terms. Cancellations, renewals, and refunds follow storefront policies.

8. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided "AS IS" without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Captions may contain errors.

9. Limitation of liability

To the maximum extent permitted by applicable law:

(a) Neither BLAID Staq nor its operators, contractors, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including (without limitation) lost profits, lost revenue, lost goodwill, lost data, business interruption, or substitute services, even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

(b) Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service — whether in contract, tort (including negligence), strict liability, or any other legal theory — will not exceed the greater of (i) US$25 or (ii) the total amount you actually paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim. These limits apply regardless of the number or nature of claims and reflect a reasonable allocation of risk in light of the consumer price of the Service.

(c) This Section sets a maximum on damages a court or arbitrator may award; it is not a refund mechanism. Refunds for in-app purchases and subscriptions are handled through the relevant storefront's refund policy (Apple App Store, Google Play) and are not governed by this Section. You agree to seek refunds through the storefront before pursuing other remedies.

(d) Statutory rights. Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any limitation in this Section is not permitted by the law of your jurisdiction, that limitation will be reduced to the minimum permitted by that law and the rest of these Terms will continue in full force. Nothing in these Terms limits liability that cannot be excluded under mandatory law, including (where applicable) liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or rights you have as a consumer under mandatory consumer-protection laws (for example in the European Economic Area, the United Kingdom, or U.S. state consumer-protection statutes).

10. Changes

We may update these Terms or fair-use limits. Continued use may constitute acceptance where permitted by applicable law.
